Heard learned counsel for the petitioners and learned APP for the State.
Petitioners seek bail in a case registered for the offences punishable under Sections 379 and 411/34 of the Indian Penal Code.
The petitioners were apprehended while they were carrying away stolen animals on a vehicle. The petitioners are in custody since 27.01.2020. Investigation of the case is already complete against the petitioners.
Considering the nature of allegation and completion of investigation, let the petitioners, above named, be released on
Patna High Court CR. MISC. No.17046 of 2020(2) dt.03-06-2020 2/2 bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sarmera P.S. Case No. 22 of 2020, subject to the following conditions:- (a) The petitioners shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioners.
(b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
(c) The petitioners shall not leave the country without permission of the learned court below.
If the petitioners would not be able in furnishing sureties due to lockdown, they shall be provisionally released on their personal bond and the provisional bail shall be confirmed only after production of the bailors within fifteen days of restoration of normal function of the Court.
