Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379, 354, 504, 506 and 34 of the Indian Penal Code. 3.
Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and have been
Patna High Court CR. MISC. No.22578 of 2024(2) dt.25-04-2024 2/3 falsely implicated in the instant case by the informant with general and omnibus allegation of assault. It is next submitted that petitioner No. 3, Sohan Mahto, is alleged to have assaulted the son of the informant by an iron dab causing injury on back side of the head but then from perusal of the order impugned, it would manifest that the injury suffered by the injured is simple in nature. It is next submitted that informant alleges that his son was going to a temple where he saw that the accused persons were gambling on which he objected as a result of which an altercation took place and occurrence is alleged to have taken place. It is further submitted that from the side of the petitioners also Khusrupur PS Case No. 366 of 2023 dated 24-8-2023 has been instituted against the side of the informant and petitioner No. 4 herein received serious injury on account of which he was admitted in PMCH.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-
