Petitioner is seeking anticipatory bail in connection with Ratanpura P.S. Case No.42 of 2017 registered for offences punishable under Sections 304B and 201/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is widow mother-in-law of the deceased and in the present case the husband of the deceased has already been granted regular bail by a learned co-ordinate Bench of this Court vide order dated 10.05.2018 passed in Cr.Misc.No.15181 of 2018. It is submitted that there is no specific allegation against this petitioner and in fact the witnesses in the case diary have stated that the

Patna High Court Cr.Misc. No.53199 of 2018 (2) dt.08-10-2018 daughter-in-law of this petitioner died of snack biting and body was thrown in the river because the dead body of a person due to snack bite is not burnt.

On the other hand, learned APP for the State opposed the prayer for anticipatory bail by submitting that the petitioner is absconding in the case and process under Section 83 Cr.P.C. has also been issued.

In the given facts and circumstances of the case, where process under Section 83 Cr.P.C. has already been issued, if the petitioner surrenders in the court below within four weeks from today and prays for regular bail, in the facts and circumstances of the case, the court below will consider the bail application of the petitioner on the same day keeping in mind that the husband of the deceased has already been granted regular bail by a learned coordinate Bench of this Court.

This application is disposed off with the aforesaid observations and directions.
