JUSTICE SUDHIR SINGH ORAL ORDER 29-08-2016 Since both the cases arise out of Kudhani P.S. Case no. 335 of 2015, they have been heard together and are being disposed of by this common order.
The petitioners seek bail in a case instituted under Sections 394 and 307 of the Indian Penal Code and 27 of the Arms Act.
Allegation is while informant was going on his motorcycle, the accused persons fired shot on his waist and looted away his motorcycle.
It has been submitted on behalf of the petitioners that they are in custody since 16.3.2016 and 2.4.2016 respectively. Chargesheet has been submitted against the petitioners. No
Patna High Court Cr.Misc. No.26849 of 2016 (3) dt.29-08-2016 2/2 allegation of tampering of witnesses is alleged against the petitioners. The looted motorcycle is said to have been recovered from the possession of co-accused, namely, Mayank. Petitioners have been made accused in the present case for the reason that they were apprehended along with the co-accused, namely, Mayank in Sadar P. S. case no. 557 of 2015 in which petitioners have already been granted bail.
On behalf of the State, it is submitted that petitioners are not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, in connection with Kudhani P.S. Case no. 335 of 2015.
