1. Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Manikpur Police Station Case No. 134 of 2024, disclosing offences under Sections 115(2), 127(1), 118(1), 117(a), 109, 74, 352, 351(2), 3(5) of the BNS, 2023.

3. As per the prosecution case, on 31.10.2024. in the morning, the elder brother-in-law of the informant was abusing in drunken condition and when the informant's husband tried to placate him, he tried to assault her husband upon which the informant informed the police. Thereafter, the informant's elder brother-in-law went away. Subsequently, in the afternoon,

Patna High Court CR. MISC. No.24321 of 2025(2) dt.02-05-2025 2/3 he came along with other accused persons and petitioners assaulted the informant's husband on his head with knuckle due to which he sustained injury.

4. Learned Counsel for the petitioners submits that both the parties are closely related as would be evident from the FIR itself. A counter case bearing Manikpur P.S. Case no. 135 of 2024 has been lodged by the wife of the petitioner no. 1 against the informant and others. No injury report has been brought on record by the prosecution as would be evident from the impugned order. Both the parties, being family members, have filed compromise petition before the concerned court.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that both the parties are closely related, case and counter case is there and the injuries caused to the victim have not been brought on record by the prosecution, I am inclined to grant the petitioners privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount
