JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 14-08-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of anticipatory bail arises out of Katoria P.S. Case No. 331 of 2014, disclosing offences under Sections 447,323,307,504,109/34 of the Indian Penal Code. The petitioner, though not named in the First Information Report, it appears that his name cropped up on the basis of confessional statement of co-accused Kunal Kumar Singh before the Police from whose possession a stolen Xylo vehicle was recovered.

Keeping in view the nature of offence, I am not inclined to grant the petitioner privilege of anticipatory bail. This application for anticipatory bail is, hereby, rejected.

Patna High Court Cr.Misc. No.32619 of 2015 (2) dt.14-08-2015 Petitioner is directed to surrender before the Court below within six weeks and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit without being prejudiced by rejection of present application for anticipatory bail.
