The petitioner seeks bail in connection with Nirmali P.S. Case No.59 of 2016 registered under Section 380 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the informant has raised suspicion against the co-accused Chandan Kumar about committing theft of his Lap-top and the petitioner is not named in the F.I.R. In course of investigation, the co-accused Chandan Kumar, who is co-villager of the petitioner, was arrested and confessed that he had gone to the house of the petitioner and asked

No.27599 of 2016 (2) dt.12-07-2016 2/2 the petitioner to keep the Lap-top and returned to his house and, later on, the police official came to the house of the petitioner and recovered the Lap-top, which is alleged to be theft, from there. The petitioner had permitted the co-accused Chandan Kumar to keep the Lap-top as he had no knowledge that the said Lap-top is a theft article. The petitioner having no criminal antecedent is in custody since 31.05.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Birpur (Supaul), in connection with Nirmali P.S. Case No.59 of 2016.
