The petitioners being the parents, brother and sister of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 498A, 304B, 34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
It is alleged that Pintu Kumar, who happens to be the brother-in-law of the elder daughter of the informant, performed love marriage with other daughter of the informant, namely, Punam Kumari, on 02.05.2009 and both started residing at Delhi after the marriage but after sometime the
Patna High Court Cr.Misc. No.32587 of 2015 (2) dt.11-08-2015 2/2 victim complained about torture and demand of dowry and ultimately she was being killed.
It is submitted by learned counsel for the petitioners that as per FIR itself the victim performed love marriage with Pintu Kumar and they used to reside at Delhi whereas the petitioners being family members of Pintu Kumar have no concern either on occasion of love marriage or postmarriage affairs of the victim or her husband. It is further submitted that as per own admission of the informant, the informant came to know about the occurrence on 24.05.2015, but the FIR was registered on 03.06.2015.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Gaya in connection with Alipur P.S. Case No.49 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
