In course of argument, learned counsel for the petitioner has produced a copy of the statement of the victim recorded under Section 164 of the Code of Criminal Procedure. Let the same be kept on record.

The petitioner seeks pre-arrest bail in connection with Bhagwanpur P. S. Case No. 109 of 2017 registered under Section 366-A of the Indian Penal Code.

Regard being had to the statement of the victim recorded under Section 164 of the Code of Criminal Procedure,

S. Case No. 109 of 2017, subject to the conditions as laid down under Section 438
