JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-06-2020 Heard Mr. Sanjiv Kumar Singh, learned counsel for the petitioner and learned APP for the State. The petitioner, who is the mother-in-law of the deceased, seeks bail in connection with Kharagpur P.S. Case No. 450 of 2019, dated 30.12.2019, instituted for the offence under Section 304(B) of the Indian Penal Code. From the perusal of the F.I.R., it appears that the daughter (deceased) of the informant was taken to her

Patna High Court CR. MISC. No.16707 of 2020(2) dt.03-06-2020 2/3 matrimonial home. After a lapse of couple of days, the informant came to learn that her daughter has died. The family members of the informant were never informed about the cause of the death. There was a persistent demand of money from the in-laws of the deceased. The marriage of the deceased with the son of the petitioner had been solemnized in the month of August, 2019.

Hence, the prosecution.

It has been urged on behalf of the petitioner that no specific accusation has been levelled against her. There is a possibility of the deceased dying her natural death. It has further been submitted that the petitioner is an old person and in the post-mortem report, there is only suspicion that the deceased has been poisoned. The petitioner is stated to be in custody since 30.12.2019.

Considering the period of custody of the petitioner, she is directed to be released on bail on her furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction
