The petitioner seeks bail in a case registered under Sections 457 and 380 of the Indian Penal Code. It is contended that the petitioner has been implicated in this case only on the basis of alleged statement of his mother that he had brought two sarees which were burnt by her considering that the same must have been thrown as 'Totka' (Black Magic). It is further contended that except so-called selfincriminating confessional statement of the petitioner and the coaccused, Kundan Kumar recorded in paragraph nos.6 and 7 of the case diary, there is no material against the petitioner.

No.26586 of 2016 (2) dt.12-07-2016 2 / 2 Having regard to the facts and the circumstances of the case, the petitioner, Bittu Pandey, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Nawada in connection with Hisua P.S. Case No.59 of 2016 with a condition that, if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
