The petitioner seeks bail in connection with Nautan P.S. Case No. 219 of 2024 instituted for the offence under Sections 341, 323, 325, 379, 504/34 of the Indian Penal Code (IPC). Later Section 302 of the IPC was added. 3.

As per the prosecution case, accusation against the petitioner and others is of assaulted the informant, who later died.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 13-01-2025. Petitioner bears one criminal antecedent/s, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. There is no specific allegation against the petitioner, rather allegation is general and omnibus in nature. As per postmortem report, the cause of death is septicemia. Charge sheet is submitted in this case. Similarly situated co-accused has been granted bail by a Co-ordinate Bench of this Court vide order dated 25-09-2024, passed in Cr. Misc. No. 67198 of 2024. 6.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, claim based on parity and charge sheet being submitted, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Nautan P.S. Case No. 219 of 2024.
