The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 504, 307, 120B of the Indian Penal Code and 27 of the Arms Act. It is alleged that co-accused Ramashankar Singh, Bittu Singh, Sonu Kumar, Ruchi Kumari, Pammi Kumari and Sweta Kumari including the petitioners assaulted the son of the informant with 'lathi' and 'danda' when co-accused Rmashankar Singh resorted to fire causing injury to Badal Singh, Jitendra Singh, Rajendra Singh, Avinash Singh and the informant. It is submitted by learned counsel for the petitioners that none of the injured have received any injury by fire arm and

Patna High Court Cr.Misc. No.35374 of 2015 (2) dt.07-09-2015 2/2 except two injuries of Nagendra Singh, all the injuries have been found to be simple in nature one of the grievous injury is fracture. Accusation of assaulting to Nagendra Singh, is omnibus and general against all the accused persons and there is counter version of the occurrence wherein the petitioners' side has also received injuries. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 2nd Class, Rohtas at Sasaram in connection with Navhatta P.S. Case No.62 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
