Petitioner is accused in connection with Dumariya P.S. Case No. 11 of 2000 registered under Sections 302/201 of the I.P.C.

Learned counsel appearing on behalf of the petitioner submits that this is a case of misuse of the privilege of bail about 9 years. While the charge was framed on 07.11.2013, but no prosecution witness was examined and on 29.04.2006 due to not proper pairvi the bail bond was cancelled. The petitioner was apprehended by the Police on 28.05.2015 and since then he is in custody.

Having considered the facts and circumstances of the

Patna High Court Cr.Misc. No.29051 of 2016 (2) dt.20-07-2016 2/2 case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge, Gaya in connection with S.T. No. 14 of 2016 arising out of Dumariya P.S. Case No. 11 of 2000. Out of two sureties, one surety must be parents or close relatives of the petitioner.
