The petitioner seeks bail in Benipatti P.S. Case No. 191 of 2021, registered for the offence punishable under Sections 399, 402, 413 and 414 of the Indian Penal Code and sections 25(1-b)a, 26 and 35 of the Arms Act. As per the prosecution case, on secret information that some criminals have assembled near Pali Bridge to commit crime, a raid was conducted. After seeing the police party four persons riding on two motorcycles started fleeing away, but on chase, one of them was apprehended by the police who disclosed the name of petitioner, as one of the persons who fled away.

It is submitted on behalf of the petitioner that

Patna High Court CR. MISC. No.18920 of 2022(2) dt.26-05-2022 2/2 petitioner has falsely been implicated in this case. Petitioner is not named in the FIR. During course of investigation, name of this petitioner has come in this case on the basis of confessional statement of co-accused Nikesh Kumar Jha who was apprehended on the spot. No arms and ammunition has been recovered from possession of this petitioner. Petitioner is in custody since 24.12.2021. Investigation is complete. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Benipatti, Madhubani in connection with Benipatti P.S.
