ANJANA MISHRA ORAL ORDER 09-11-2015 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Basantpur P.S. Case No.258 of 2012 for allegedly having committed the offence under Sections 341, 323, 324 and 307/34 of the Indian Penal Code. Learned counsel for the petitioner submits that there is no specific allegation against the petitioner of having assaulted the injured. The only allegation as made out in the F.I.R. is that the petitioner had taken away the informant from the betel shop and thereafter one Bhim Singh had allegedly attacked the informant.

Considering the aforementioned facts and

Patna High Court Cr.Misc. No.32972 of 2015 (3) dt.09-11-2015 2/2 circumstances and that the petitioner has no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan, in connection with Basantpur P.S. Case No.258 of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
