The petitioner is accused in connection with Madanpur P.S. Case No. 23 of 2016, registered under Sections 414, 420, 467, 468, 471/34 of the Indian Penal Code and Section 4, 21, 26(A), 40 of Bihar Minor Minerals Concession Rule, 1972.
The accusation is that in course of checking of brickkiln of the petitioner by the Mineral Development Officer, Aurangabad one truck was found at brick-kiln and coal was being unloaded there. On query, Ranjay Kumar Choudhary, driver and Shivdutt Yadav, sub-driver produced two challans one for D.C.M. Itt Bhattha, Baliya and other for the brick kiln of the petitioner, which appears to be forged. Till that time half coal of
Patna High Court Cr.Misc. No.28023 of 2016 (2) dt.15-07-2016 2/2 the truck was unloaded there while all papers were produced by the brick kiln staff, but the paper regarding no objection certificate of environment department was not produced. Thereafter, half loaded truck was seized.
Learned counsel for the petitioner submits that driver and co-driver have already been released on bail. The petitioner, who is the owner, is in custody since 10.06.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S.
