2. Petitioner apprehends arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3 . It is alleged that 378 liters illicit foreign liquor was recovered from container bearing registration No. UP81DT9744.

4. It is submitted on behalf of petitioner that petitioner has falsely been implicated in this case only on the basis of confessional statement of co-accused persons who was apprehended on the spot. No incriminating material has been recovered from the conscious possession of petitioner and he is

Considering the aforesaid fact, clean antecedent and others circumstances of the case , this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive special Excise Court No. 2 Bhojpur Ara in connection with Koilwar P. S. Case No. 25 of 2025 , subject to condition as laid down under Section 482 ( 2 ) of BNSS 2023 .
