The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 415, 379, 411, 504/34 of the Indian Penal Code. It is alleged that the co-accused Khattar Ram chopped up the she-goat of the informant and was dressing it. When the informant went to the Police Station to complain but on way back to his house the petitioner and co-accused Khattar Ram abused and threatened the informant.
It is submitted by the learned counsel for the petitioner that the thrust of accusation is against co-accused Khattar Ram. Though the First Information Report was lodged on 02.06.2015 but it reached to the court of learned Chief Judicial Magistrate on 05.06.2015. Statement has been made
Patna High Court Cr.Misc. No.34244 of 2015 (2) dt.24-08-2015 in para-3 of the petition that petitioner has no criminal antecedent.
Considering the thrust of accusation is against coaccused Khattar Ram, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Sri Nagar P.S. Case No. 32 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. (Dinesh Kumar Singh, J) P.K./- U T
