This application for regular bail arises out of Hilsa P.S. Case No. 471 of 2019, disclosing offences punishable under Sections 461 and 379 of the Indian Penal Code. The alleged occurrence relates to theft of a motorcycle. F.I.R. was registered against unknown. In course of investigation, the petitioner's name emerged on the basis of confessional statement of some other persons apprehended by the police. On the basis of confessional statement of coaccused, the petitioner, who was in custody in connection with the Fatuha P.S. Case No. 676 of 2019, has been remanded in the present case. It has been stated in the application on behalf of the petitioner that similarly circumstanced co-accused Md.

Patna High Court CR. MISC. No.17364 of 2020(3) dt.10-07-2020 2/2 Nasib has been granted regular bail by this Court by an order dated 23.01.2020 passed in Cr. Misc. No. 2049 of 2020. The petitioner is in custody since 08.11.2019.

Considering the submission made on behalf of the petitioner that similarly circumstanced co-accused has been allowed regular bail by this Court and the petitioner is in custody since 08.11.2019, this application is allowed. Let the petitioners above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Hilsa P.S.
