JUSTICE SATYAVRAT VERMA ORAL ORDER 22-04-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in a case registered for the offences punishable under Sections 30(a) of the Excise Act, 2018.

The learned counsel for the petitioner submits that the petitioner is in custody since 05.03.2022, charge-sheet has been submitted in this case and has antecedent of three cases. Allegation is of recovery of 187.5 litre of liquor from a Santro car.

The learned counsel for the petitioner submits that petitioner is neither the owner, nor the driver, nor was arrested from the spot and his name was disclosed by local people, who were inimical to him.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in this case and was not arrested from the spot and is neither owner, nor driver of the car, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Barun P. S. Case No.411 of 2021. The application stands allowed.
