The petitioner seeks bail in connection with Chainpur P.S. Case No. 347/2020 instituted for the offences under Sections 25 (1-b) a / 25(1-aa)/ 26 of the Arms Act. From bare perusal of the allegation as alleged in the FIR, it is manifest that apprehended accused persons disclosed the name of the petitioner and one country made Katta with three live cartridges were recovered from the house of the petitioner.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He is in custody since 30.11.2020 and he has got two criminal antecedents, which is mentioned in para 3 of the bail

Patna High Court CR. MISC. No.28615 of 2021(2) dt.23-11-2021 2/2 application. The petitioner is aged about 75 years old and charge-sheet has been submitted in this case. Learned APP for the State vehemently opposes the prayer for bail of the petitioner.

Considering the facts aforesaid, the petitioner, above named, is directed to be released on bail on his furnishing bailbonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-Iind, Bhabua, Kaimur in connection with Chainpur P.S. Case No. 347/2020.
