04-12-2017 Heard Mr. Md. Anis Akhtar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 11-09-2017 in Chauradano (Mahuawa O.P) P.S. Case No. 213 of 2017 registered for offence under Sections 272, 273, 34 of the Indian Penal Code and Sections 30(A) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail. Learned counsel for the petitioner, at the very outset, has drawn my attention to statement made in paragraph - 3 of the petition to show that petitioner is having clean antecedent. It has also been argued that petitioner has been falsely implicated on an accusation as if petitioner was on a motorcycle, from which, about 36 liters of Nepali liquor was shown to be recovered. Be that as it may, considering the nature of accusation, clean antecedent as well as period of custody, let the petitioner namely Ashok Kumar Prasad Yadav @ Ashok Kumar Yadav be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 7th cum Special Judge Excise, Motihari, District - East Champaran in connection with Chauradano (Mahuawa O.P) P.S. Case No. 213 of 2017.
