The petitioner seeks bail in connection with Gobindganj P.S. Case No. 134 of 2014 dated 01.08.2014, arising out of Complaint Case No. 1311 of 2014 instituted for the offences under Sections 419, 420, 467, 468, 471 and 120B of the Indian Penal Code. The petitioner is alleged to have purchased a plot of land belonging to the father of the informant by asking someone to masquerade as the executant. Investigations revealed that the photograph on the saledeed was of one Akaloo Mian who is a family member of the informant.

Learned counsel for the petitioner has

Patna High Court Cr.Misc. No.54475 of 2018(2) dt.04-09-2018 2/2 submitted that he himself has been cheated in as much as he did not know as to who the father of the informant was. Only on being satisfied that the land belongs to the father of the informant, he paid the consideration money whereafter the sale deed was executed. The falsity of the allegation further appears from the fact, it has been argued, that the person who masqueraded as the father of the informant and executed the sale deed has not been made accused by the informant.

The petitioner is in custody since 25.05.2018. For the facts stated above, the petitioner above named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Gobindganj P.S. Case No. 134 of 2014.
