The present application has been filed for modification of the order dated 18.09.2017 passed in Cr.Misc.No. 45365 of 2017, by which the petitioner was granted anticipatory bail in connection with Complaint case No.213C of 2016, pending in the court of Judicial Magistrate, 1st class, Masaurhi (Patna) and the petitioner was directed to surrender and furnish bail bond in the court below within a period of six weeks.

It is submitted on behalf of the counsel for the petitioner that due to some unavoidable reasons the petitioner

Patna High Court CR. MISC. No.24589 of 2019(2) dt.17-04-2019 2/2 could not surrender and furnish bail bond in the court below well within time.

It appears that on 18.09.2017 the bail was granted to the petitioner but he did not surrender and now after a lapse of about one year seven months, he is approaching this court by filing this modification application. This delay in approaching the court after a long time dis-entitles the petitioner from seeking any relief.

I find no merit in the modification application. The same is dismissed.
