JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-08-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 342, 323 and 307/4 of the Indian Penal Code.
The prosecution case is that after protest being made for abusing the informant and his family members, petitioners assaulted the informant, his wife and daughter-in-law. It is submitted by learned counsel for the petitioner that injuries have been found to be simple in nature. For the occurrence of 13.11.2014 at 11 AM, the FIR was registered on 14.11.2014 at 3.15 PM when the FIR reached to the court of learned In-Charge ACJM on 20.11.2014 which suggests that the FIR was registered
Patna High Court Cr.Misc. No.32548 of 2015 (2) dt.14-08-2015 2/2 by antedating. There is counter version of the occurrence also. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Darbhanga in connection with Ashok Paper Mill P.S. Case No. 96 of 2014 , subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
