2. The petitioner is apprehending his arrest in Complaint Case No. 1501 of 2023 registered under Sections 120(B), 420, 406, 465, 468 of the Indian Penal Code.

3. According to allegation, the petitioner sold the land of Bihar Sarkar (Government of Bihar) in favour of the complainant and by this way, the petitioner deceived the complainant.

4. It has been submitted on behalf of the petitioner that the petitioner is ready to return Rs. 2,85,000/- to the complainant subject to the condition that he shall not claim the land, in question, and he shall withdraw the case(s) including the present one pending against the petitioner.

5. Learned counsel for the complainant submits that he shall not claim the land, in question, as the land belongs to the

Patna High Court CR. MISC. No.19659 of 2025(4) dt.23-12-2025 2/2 Government of Bihar. He also submits that he is ready to receive the draft to which, the learned counsel for the petitioner assures to deposit in the learned court below. Learned counsel for the complainant assures to withdraw the criminal cases also filed by him against the petitioner regarding the present dispute.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class/concerned court, Banka in connection with Complaint Case No. 1501 of 2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/ 482(2) of BNSS, 2023.

7. The bail bond of the petitioner will be accepted/confirmed only after liquidation of the draft in favour of the complainant by the learned court below itself. (Nawneet Kumar Pandey, J) A.K.V.//- U T
