JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-08-2015 Heard learned counsels for the petitioner and the State. The petitioner being the owner of the tractor is apprehending arrest in a case registered for the offences punishable under Sections 467, 468, 471, 120B, 406 and 420 of the Indian Penal Code.

The prosecution case is that trucks were intercepted while carrying goods without relevant permit/documents. It is submitted by learned counsel for the petitioner, being owner of the trucks, in question, that his trucks were registered validly. Moreover, the impugned order reflects that verification report of the trucks, in question, has not been produced by the prosecuting agency before the learned court below. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

No.33123 of 2015 (2) dt.12-08-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on provisional anticipatory bail for four months, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S. Case No.27 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.

The provisional bail of the petitioner will be confirmed on verification of the fact that the trucks, in question, were validly registered and insured on the date of seizure, otherwise the petitioner will surrender or pray for regular bail. (Dinesh Kumar Singh, J) Ashwini/- U T
