JUSTICE SHIVAJI PANDEY ORAL ORDER 02-08-2017 Perused the report of the Chief Judicial Magistrate, Bhagalpur dated 19.7.2017 where reason for non-completion of trial has been stated. It has been stated that on account of non-production of three official witnesses the trial has not been concluded. Sheo Narayan Mandal, Nishi Kant Nishi and Raj Kishore Singh were posted at headquarter Patna. Md. Kaisher Alam, Investigating Officer is not available at Bhagalpur.

This Court directs that I.G. ATS Headquarter must ensure presence of the said persons on the date fixed. Let this order be communicated upon I.G, A.T.S Headquarter.

The Superintendent of Police, Bhagalpur must ensure production of Md. Kaisher Alam.

Patna High Court Cr.Misc. No.27235 of 2016 (3) dt.02-08-2017 Prayer for extension of two months time is granted to conclude the trial.
