JUSTICE RAKESH KUMAR ORAL ORDER 30-06-2016 Heard Sri Ranjan Kumar Singh, learned counsel for the petitioners and learned Addl. Public Prosecutor. Two petitioners, apprehending their arrest in Goraul P.S. Case no.336/2015 registered for the offence under Section 307 and other allied Sections of the Indian Penal Code, have prayed for grant of anticipatory bail.
It was submitted by learned counsel for the petitioners that as per F.I.R., occurrence had taken place on 04.11.2015, however F.I.R. was lodged on 22.11.2015 i.e. after 18 days. He further submits that the informant himself in the F.I.R. has stated that after the occurrence, he tried to get the dispute settled through a Panchayati. He submits that the petitioner has been falsely implicated in the present case and after lodging the
Patna High Court Cr.Misc. No.26471 of 2016 (2) dt.30-06-2016 2/2 F.I.R., the dispute has already been settled in between the parties. Be that as it may, since F.I.R. was lodged at belated stage and the informant himself firstly took steps for settling the dispute through Panchayati, the Court is satisfied that it is a fit case for extending the privilege of anticipatory bail. Accordingly, let the petitioners, namely, (i) Rajendra Singh (ii) Prem Shankar Patel, in the event of their arrest or surrender within six weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Goraul P.S. Case no.336/2015, subject to condition as laid down in Section 438(2) of the Code of Criminal Procedure.
