JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-06-2019 This is an application for grant of anticipatory bail in connection with Banka P.S. Case No. 746 of 2018, disclosing offences under Sections 147, 148, 149, 323, 325, 354 (B), 380, 427, 452, 504 and 506 of the Indian Penal Code.
Patna High Court CR. MISC. No.20907 of 2019(3) dt.19-06-2019 2/2 Allegation against the petitioners is of assault to the informant and also tore the sari and blouse of Rita Devi and also snatched some household articles.
Submission of the learned counsel for the petitioners is that there is case and counter case between the parties and a complaint lodged by the petitioners are earlier and the prescription of the Doctor also annexed with the F.I.R. that disclose no serious injury on the person of the complainant. Heard learned A.P.P. also.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Banka P.S.
