The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 148, 149, 323, 337, 307, 332, 333, 353, 427, 283, 188, 504 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is a person with one antecedent but then the antecedent is with respect to the same occurrence for which the present FIR has been instituted, it is next submitted that the informant in the FIR alleges that 76 named and 300-400 unknown persons blocked the Nabinagar main road by burning tires and pelted stones over the police and the crowd armed with

Patna High Court CR. MISC. No.21894 of 2023(2) dt.05-07-2023 2/2 weapons attacked the police and thus created obstruction in discharge of official duties.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is next submitted that no specific overt act is alleged against he petitioner.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Nabinagar P.S. Case No. 180 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
