JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences under Sections 25(1-B)/26/35 of the Arms Act. Petitioner and three others were caught in a vehicle and allegedly one rifle and five live cartridges were recovered from the possession of the petitioner. The petitioner could not show the documents relating to the seized rifle and cartridges but before the learned Court below it was argued on behalf of the petitioner that the seized rifle belonged to brother of the petitioner and as a matter of fact the petitioner was arrested from his house. Learned Counsel for the petitioner drew my attention to Annexure-2 to this petition, which appears to be photostat copy of
Patna High Court Cr.Misc. No.27878 of 2016 (3) dt.19-09-2016 2/2 licence issued in the name of brother of the petitioner. Petitioner does not have any criminal antecedent and is languishing in jail custody since 17.05.2016.
Considering the aforesaid facts and circumstances of the case as well as submission of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur in Bhabhua P.S. case No.325 of 2016.
