JUSTICE MADHURESH PRASAD ORAL ORDER 17-02-2018 Heard counsel for the petitioner and the State. Petitioner is an accused in a case registered for offence under sections 30, 38 and 41 of the Bihar Prohibition Act. Allegation the FIR relates to the recovery of prohibited liquor being carried on a truck followed by a four wheeler on which the petitioner was also travelling. Petitioner is in custody since 6.11.2017. Prior to the lodging of this case, he is accused in other case mentioned in paragraph 3 of the bail application.

Petitioner claims parity with co-accused Balendra Singh who was also travelling with the petitioner in the four wheeler and has been allowed bail by a bench of this Court vide order dated 13.2.2018, passed in Cr.Misc.No. 8556 of 2018. Considering the aforesaid submissions, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.

No.63299 of 2017 (3) dt.17-02-2018 two sureties of the like amount each to the satisfaction of the Additional Sessions Judge II, Siwan in Raghunathpur Police Station Case No. 197 of 2017 on the following conditions:- (a) One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(b) The petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
