JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 188, 171(E), 141(I) of Bihar Panchayati Rajya Adhiniyam and Sections 25(1-B)a, 26 and 35 of the Arms Act.

The recovery of illegal fire-arm and cartridges are said to have been made from the possession of the co-accused. No doubt, some incriminating documents were recovered from Bolero vehicle which was driven by the petitioner but, no fire arm was recovered from the conscious possession of the petitioner, who does not have any criminal antecedents and is languishing in jail custody since 9.5.2016.

No.29642 of 2016 (2) dt.27-07-2016 2/2 Accordingly, the petitioner is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jamui, in connection with Khaira P.S. Case No. 103 of 2016.
