JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-01-2018 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Hasanpur P.S. Case No. 160 of 2017 instituted for the offences under Sections 272 and 273 of the Indian Penal Code and Sections 47 and 30(a) of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of 34.2 litres of illicit foreign liquor from a Sumo Gold vehicle. However, the petitioner was trying to flee away when he saw the Police and thereafter he was apprehended.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and he was merely a co-passenger as well as he is neither the driver nor the owner of the said vehicle, hence he cannot be connected with

Considering the nature of accusation and the period of custody already undergone, I deem it fit and proper to enlarge the petitioner above named on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Samastipur in connection with Hasanpur P.S. Case No. 160 of 2017.
