It is contended on behalf of the petitioner that in identical matter, the Managing Director of the Housing Board has passed order in favour of one of the allottee granting relief under One Time Settlement Scheme. The petitioner wants to move before the Managing Director for such relief.

However, learned counsel for the Housing Board has submitted that the matter should go before the Pricing Committee. The order passed by the Managing Director has been

Patna High Court CWJC No.10640 of 2012 dt.04-05-2016 2/2 appended as Annexure-9 to the supplementary counter affidavit which clearly indicates that a direction has been given to the concerned Revenue Officer to recover only the difference of the amount from the allottee granting him benefit under One Time Settlement Scheme. Accordingly, this writ application is being disposed of with a liberty to the petitioner to approach the Managing Director of the Housing Board by filing a representation along with a copy of this order and also a copy of the order passed by the Managing Director in the matter of Krishna Kumar Sinha (Annexure-9). If such representation is filed, let the same be considered by the Managing Director also in the light of his earlier order, if the case of the petitioner is found on identical footing.
