JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-07-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Sessions Trial No. 38 of 2015 arising out of Sasaram (Modal) P.S. Case No. 692 of 2014 registered under Sections 148, 149, 506, 307 and 504 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that it would appear from the F.I.R. that there is general allegation against seven persons including the petitioner to shot fire causing injury to Sachin, Himansu and Nitesh @ Chhotan. The prayer for bail of the petitioner along with one Vijay Singh was earlier rejected on merit vide order dated 23.04.2015 passed in Criminal

Patna High Court Cr.Misc. No.27856 of 2016 (2) dt.14-07-2016 Misc. No. 8338 of 2015 with Criminal Misc. No. 10988 of 2015. It is further submitted that similarly situated co-accused, Ashok Singh @ Ashok Kumar Singh, has already been granted privilege of bail by a Bench of this Court vide order dated 18.05.2016 passed in Criminal Misc. No. 22279 of 2016 on taking into consideration the period of custody. The petitioner is accused in Sasaram (Modal) P.S. Case No. 683 of 2014 which is lodged by the informant except that the petitioner has no criminal antecedent and he is in custody since 15.09.2014.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge- IV, Rohtas at Sasaram, in connection with Sessions Trial No. 38 of 2015 arising out of Sasaram (Modal) P.S. Case No. 692 of 2014. Out of two sureties, one surety must be the close relative of the petitioner.
