====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 21-07-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Turkauliya (Banjariya) P.S. Case No. 128 of 2022 lodged under Sections 414, 34 of the Indian Penal Code.

The prosecution story is that the two persons including the petitioner were apprehended with stolen Hero Honda motorcycle.

Learned counsel for the petitioner submits that petitioner is in custody since 13.02.2022 and having clean antecedent. Learned counsel for the petitioner further submits that co-accused Rajeev Kumar has already been granted bail by the Co-ordinate Bench of this Court vide order dated 01.06.2022 passed in Cr. Misc. No.20816 of 2022.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Turkauliya (Banjariya) P.S. Case No. 128 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

The petitioner is directed to appear on each and every date before the Trial Court, in case of non-appearance for two consecutive dates, shall resulted into cancellation of his bail bond. If he shall involve in such type of activities again, the prosecution shall be at liberty to move for cancellation of his bail bond.

With this observation, the bail application stands allowed.
