JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-395, 396, 397 of the Indian Penal Code. Petitioner is not named but in course of investigation, some witnesses claimed before the I.O. that at the time of occurrence, the dacoits were uttering the name of each others and in that course; the witness came to know about the name of the petitioner. Moreover, in course of investigation, some co-accused were arrested and confessed their guilt, disclosing the name of the petitioner. It appears that except the aforesaid material as well as some criminal antecedent of the petitioner, there is nothing against him.

No.26155 of 2016 (2) dt.05-07-2016 2/2 Considering the above-said facts and circumstances of the case as well as submission of the parties and also taking note of this fact that having more or less similar allegation, some coaccused have already been granted privilege of bail, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Doriganj P.S. Case No. 96 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra.
