JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 366A, 323, 504 and 120B of the Indian Penal Code.

The accusation is of kidnapping the minor daughter of the informant. In 164 Cr. P.C. statement, the victim got her age recorded as 14 years when the court also assessed her age as such, though, as per the medical opinion, the victim was found between 19 to 20 years. In 164 Cr. P.C. statement, the victim has stated that she was being kidnapped by co-accused Bhola and was taken to Delhi where after regaining consciousness she found this petitioner and his brother-in-law Manmohan Rai present. Considering the thrust of accusation against the coaccused Bhola Rai, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Muzaffarpur in connection with Town P.S. Case No. 12 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
