JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-07-2016 Heard learned counsel for the petitioner and the State. Petitioner is languishing in custody since 10.5.2016 in a case registered for the offences under Sections 20(1)(c)/22/27 of the N.D.P.S. Act.

On the information received by the informant about selling of Ganja, 10-12 persons were apprehended including the petitioner. From possession of the petitioner, 60 pouch (Puria) ganja each contains 10 gram total 600 gram along with 980 cash were recovered.

It is submitted by learned counsel for the petitioner, the petitioner was apprehended on suspicion. The recovery admittedly is of small quantity.

Statement has been made in paragraph-3 of the

Patna High Court Cr.Misc. No.28735 of 2016 (2) dt.13-07-2016 2/2 petition that the petitioner has got no criminal antecedent. Considering the recovery of small quantity of ganja and statement made in paragraph-3 of the petition, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.D.J.II, Patna in connection Special Case No.17 of 2016 arising out of Rajeev Nagar P.S. Case No.96 of 2016.
