2. Petitioner seeks regular bail in connection with Beldaur P.S. Case No. 443/ 2024 dated 24.12.2024 registered for the offence(s) punishable under Section(s) 329(3), 111, 109, 303(2), 308(2), 308(5), 352, 351(2) and section(s) 3(5) of the B.N.S. and section 27 of the Arms Act, 1959.

The main submissions advanced by the petitioner's counsel are that the main allegation is against co-accused, Narayan Yadav who happens to be the father of the petitioner and according to the prosecution's allegation, the petitioner and his father as well as other co-accused, Jawahar Yadav came at the land of the informant and made extortion demand of Rs. two lacs but the said allegation is not specific against this petitioner and further, the allegation of firing is against the co-accused, Narayan Yadav, father of the petitioner, and as per the prosecution's story, a sum of Rs. 15,000/- was given by the

Patna High Court CR. MISC. No.19867 of 2025(3) dt.28-04-2025 2/2 informant on account of fear of the firing to Narayan Yadav and the said amount has not been given to the petitioner. It is further submitted that petitioner has been languishing in jail since 28.12.2024 and though, against him there is criminal antecedent of one case but the same relates to the offences under sections 379, 411 read with section 34 of the IPC and the investigation against the petitioner has been completed.

4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.

In the facts and circumstances of this case and considering the aforesaid submissions advanced by the petitioner's counsel coupled with the custody period of the petitioner as well as nature of allegation appearing against him and the completion of investigation against him, this court is inclined to grant the relief of regular bail to the petitioner. Accordingly, let the petitioner named-above be released on bail in connection with Beldaur P.S. Case No. 443/ 2024 on furnishing bail bond of Rs.20,000/-( Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
