Petitioner is in custody in connection with Special Case No. 22 of 2017, arising out of Excise Case No. 194 of 20172018 and section 20(b) of the NDPS Act. Mr. Krishna Prasad Singh, Sr. Advocate appearing on behalf of the petitioner submits that the petitioner was apprehended with 700 grams Ganja. He submits with reference to the act that 700 grams Ganja comes within the purview of small quantity and the maximum sentence for such offence is six months.

There is statement on affidavit that the petitioner has no criminal history.

In view of the above, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge cum Special Judge, Madhepura in connection with Special Case No. 22 of 2017, CIS No. 22 of 2017 arising out of Excise Case No. 194/2017-2018 on the condition that the bailors should be family members of the petitioner.
