JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, on the basis of call details of stolen mobile, one Vivek Kumar Singh was arrested and the aforesaid stolen mobile was recovered from possession of the above stated co-accused Vivek Kumar Singh. The co-accused Vivek Kumar Singh was interrogated and his confessional statement was recorded and the aforesaid co-accused Vivek Kumar Singh disclosed that seized mobile had been given to him by the petitioner. Subsequently, some others were also arrested and they too disclosed that stolen mobiles had been given to aforesaid coaccused Vivek Kumar Singh and some others by the petitioner.

Patna High Court Cr.Misc. No.26163 of 2016 (2) dt.05-07-2016 2/2 Learned counsel for the petitioner points out that coaccused Vivek Kumar Singh has already been granted privilege of bail by the learned court below itself but the prayer for bail of the petitioner was rejected by the concerned court without any material.

From perusal of the impugned order, I find that except the above stated materials, there is nothing against the petitioner. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Basantpur P.S.Case No.11 of 2016.
