JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-07-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners are accused in connection with Bochahan P.S. Case No. 30 of 2016 registered under Section 302/34 of the Indian Penal Code.

The accusation of informant is that on 07.03.2016 at about 1 A.M. in the night he came to know that his father has been murdered at the Chock of Sarswati Vidya Mandir. Then, he went there and saw his father was laying pool with blood sustaining sharp cutting injury. The informant raised suspicion against the petitioners and two others having hand in the murder of his father due to earlier dispute.

No.27865 of 2016 (2) dt.14-07-2016 Learned counsel for the petitioners submits that it would appear from the F.I.R. and re-statement of the informant that he has only raised suspicion against the petitioner sand others named in the F.I.R. having hand in the murder of his father and after 13 days of the occurrence one Ashok Singh, Bataidar of the informant, claimed himself as an eye witness to the occurrence and stated that petitioners and others named in the F.I.R. had assaulted the father of the informant through Dab while only one injury was found on the persons of the deceased. It is further submitted that petitioners are in custody since 08.03.2016. Having regard to the facts and the circumstances of the case, the petitioners above named, are directed to be released on bail on furnishing bail bond of Rs.

10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-cum-Sub Judge, Muzaffarpur, in connection with Bochahan P.S. Case No. 30 of 2016. Out of two sureties, one surety must be the close relative of the petitioners.
