The petitioner seeks pre-arrest bail in Parasbigha P.S.Case No.33 of 2018 registered for the offences under Sections 147, 149, 341, 323, 324, 307, 504 of the I.P.C. Accusation is that in the morning of 2.3.2018 while the informant was going to worship at Devi Sthan, Pintu Kumar used filthy language for her. On returning home the informant narrated the matter to her brother Girijesh Kumar then she along with her brother went at the house of the petitioner Pintu Bind for complaint upon which all the accused persons including the petitioner attacked upon them with intent to kill in which both sustained injuries. Thereafter due to intervention of the villagers matter was pacified.

No.54361 of 2018 (2) dt.28-09-2018 2/2 Submission of the learned counsel for the petitioner is that, in fact, some dispute occurred earlier on the eve of Hoi on account of pouring colour upon each other. Further submission is that in course of attack persons from both sides sustained injuries. The injuries as sustained by the informant and her brother are simple in nature. The petitioner has no criminal antecedent. Learned A.P.P. also opposed the prayer for anticipatory bail of the petitioner.
Considering the facts and circumstances of the case, stated above, let the petitioner, in the event of his arrest or surrender before the learned court below within six weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri P.K.Bharti, J.M. 1st Class, Jehanabad, in Parasbigha P.S. Case No.33/18 subject to the conditions as laid down under Section 438(2) Cr.P.C.
