The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 306 and 120B of the Indian Penal Code.
It is alleged that the son of the informant was a student in the school where the petitioner was also a student. It is alleged that the students of the school including the petitioner assaulted the informant's son. Subsequently the son of the informant came home and committed suicide on 16.05.2013. Patna High Court Cr.Misc. No.33897 of 2015 (2) dt.13-08-2015 2/2 complaint was filed on 22.05.2013 which came to be registered as police case on 24.05.2013. On conclusion of the investigation final form was submitted as a mistake of fact under Sections 306 and 120B of the Indian Penal Code, but differing with the final form cognizance has been taken against the petitioner and others. Considering the entirety of the matter, moreover, co-accused Rajan Singh has been granted anticipatory bail vide Cr. Misc. No. 50923 of 2014, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Muffasil P.S. Case No. 120 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
