The petitioners seek bail in Azamnagar P.S. Case No.333 of 2017 registered under Sections 272 & 273/34 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

30.600 liters of foreign liquor is said to have been recovered from the motorcycle of the petitioners and they were apprehended.

It is submitted by learned counsel for the petitioners that no incriminating article has been recovered from the conscious physical possession of the petitioners. They have no concern with the seized liquor and they have been made scapegoat by the police. They have no criminal antecedent. The petitioners

Patna High Court Cr.Misc. No.1699 of 2018 (02) dt.24-01-2018 2 /2 have been languishing in custody since 11.10.2017. . In the facts and circumstances of the case, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.D.J.-IIcum-Special Judge Excise Act, Katihar in connection with Azamnagar P.S. Case No.333 of 2017.
