JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-08-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 147, 148, 149, 302, 337, 171©, 188, 504 of the Indian Penal Code and Section 27 of the Arms Act.
Petitioners are not named in the First Information Report but from perusal of the impugned order, passed by learned Sessions Judge, Nawada, it appears that in course of investigation, informant filed a petition before the Investigating Officer to add the name of some other persons including the petitioners. Patna High Court Cr.Misc. No.30715 of 2016 (3) dt.08-08-2016 2/2 accused Manish Kumar, who shot fire on the deceased. It is informed by the learned counsel for the petitioners that one F.I.R. named co-accused Pintu Singh has already been granted privilege of bail by a co-ordinate Bench of this Court.
Although, learned counsel appearing on behalf of the informant opposed the prayer but considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, Nawada, in connection with Narhat P.S.
